In an important observation, the Court clarified that a child born during a valid marriage is legally presumed to be the husband’s child, even if questions arise regarding biological parentage. Referring to Section 112 of the Indian Evidence Act, the Court noted that this provision exists to safeguard a child’s legitimacy, dignity, and long-term security in society.
The ruling explains that the husband will be considered the legal father unless it is clearly proven that there was no access between the spouses at the time of conception. The Court also advised caution in ordering DNA tests, stating that such steps can affect a child’s privacy, identity, and social standing.
At its core, the judgment reinforces a key principle: legal fatherhood is about responsibility and protection, not personal disputes. The rights and welfare of the child must always come first.
