इस देश के घटिया कानून का तो ऐसे अनेकों उदाहरण है जो पेश किया जा सकता है पर अभी हाल ही में आगरा के विष्णु तिवारी बनाम राम रहीम का मामला सुर्खियों में है।
उत्तर प्रदेश के आगरा के रहने वाले विष्णु तिवारी जिन्हें एक झूठे बलात्कार और SC/ST मामले में फंसाया गया था, जिसके चलते उन्हें अपनी जिंदगी के 20 साल जेल में बिताने पड़े।
उन्हें साल 2000 में गिरफ्तार किया गया था। जब वह सिर्फ 23 साल के थे। 2021 में इलाहाबाद हाईकोर्ट ने सबूतों के अभाव में उन्हें बेगुनाह करार दिया और बरी कर दिया। तब तक वह 43 साल के हो चुके थे। इन 20 सालों में उनके माता-पिता और बड़े भाई की मौत हो गई। जेल प्रशासन ने उन्हें पैरोल तक नहीं दिया जिसके कारण वह अपने परिवार के किसी भी सदस्य के अंतिम संस्कार में उपस्थित नहीं हो सके थे।
एक ढोंगी, बलात्कारी राम रहीम है जिस पर रेप साबित हो जाने के बाद भी वह साल के 365 दिनों में 300 दिन पेरोल पर बाहर ही रहता है। उसके जेल से बाहर पैर रखते ही गाड़ियों का काफिला देखते बनता है जैसे कोई सम्मानित व्यक्ति जेल से बाहर आ रहा हो। जेल से बाहर आने के बाद वो दरबार लगाता है व वह अपने आश्रम में मौजमस्ती करता है। क्या हमारे देश का एक देश-एक कानून का यही अवधारणा है, अगर है तो ऐसे कानून को जलाकर खाक कर देना चाहिए।
जिससे एक निर्दोष जिसको बलात्कार के झूठे मुकदमे में अपनी सारी उम्र जेल में काटनी पड़े व उसे पेरोल तक न मिले दूसरी तरफ एक बलात्कारी जिसको कोर्ट ने गुनाहगार साबित कर दिया हो वह पेरोल पर जेल से बाहर ही रहता है।
